- Negligence: This theory states that the person claiming product liability needs to show that the manufacturer is indebted by a duty of care to all potential customers. Lastly, it is required to show that there is a direct cause and effect between that breach and the injuries sustained by the person.
- Warranty: This theory provides two different types of warranties. The first is express warranty. Under this type, it is required by the manufacturer to directly state that the product is safe for its purported use. The second type is implied warranty. This states that the safety of the product is implied by the manufacturer.
Additionally, there is the legal principle of “res ipsa loquitur”. In Latin it translates to “the thing speaks for itself”. According to this principle, it is given that the defect in the product would not be possible if it weren’t for someone’s negligence. The person claiming product liability is not required to prove the negligence on the part of the manufacturer as long as he or she is able to successfully use this legal doctrine.

She graduated summa cum laude from Albany Law School in 2005 with a concentration in civil litigation.After graduating from law school, Dana Salazar served as personal law clerk to the Hon. Susan Phillips Read of the New York Court of Appeals (2005-2007). Following her clerkship, Ms. Salazar joined the Trial Practice department at Jones Day in New York, New York, where she worked on a variety of complex commercial litigation cases, including many transnational litigation cases. In 2009, Ms. Salazar returned to the Albany area as an associate at Tabner, Ryan and Keniry, LLP. In January 2015, she was a founding partner of Salazar and Erikson LLP. Ms. Salazar represents clients in all types of litigation and dispute resolution, including partnership and business association controversies, breach of contract and real estate disputes as well as personal injury and property damage cases.
